CR Squared People Catalysts (Pty) Ltd. is a business in the personal development training software industry that markets learning platforms and personal development training content.
The Laws of Motion (LOM) is the online Training System customized and managed by CR Squared People Catalysts (Pty) Ltd. The LOM is hosted on the TalentLMS cloud based infrastructure. For this reason the LOM terms and Conditions are subject to the overarching umbrella agreements and policies of TalentLMS. Specifically the policies concerned are: Terms of Service Agreement, Privacy Policy and the Security Information statements.
By proceeding users are deemed agree to all the terms and conditions of the aforementioned TalentLMS documents and with the LOM Specific Terms and Conditions below.
Users and Training Providers also agree to comply with the following additional Laws of Motion policies, statements and agreements:
· You are required to keep the information stored on your personal profile page as accurate as possible. In particular you must keep email address and other contact information updated and correct.
· You are responsible for the security of your ID and password that you use to access the LOM training platform. Do not share this information.
In the course of using the ‘school’ you may provide us with personally identifiable information. This refers to information about you that can be used to contact or identify you, and information on your use of and activities at the ‘school’ that may be connected with you.
We will display your Personal Information in your
profile page, however nowhere else on the ‘school’s’ Site. Personal Information
is or may be used for the following purposes:
· to provide and improve the ‘school’ services, features and content
· to administer your use of the ‘school’
· to fulfill requests you or your school administrator may make
In the course of using the ‘school’ you may provide information about yourself in the course of making submissions to course tutors. Any information you choose to provide should reflect how much you want other LOM Users to know about you.
We recommend that you guard your anonymity and sensitive information, and we encourage you to think carefully about what information you disclose in your profile pages. You can review and revise your profile information at any time. You should be aware that the administrator, as well as specially designated support personnel in order to provide support for technical issues you may face, may be able to:
· access information in and about your account;
· access communications history, including file attachments, for your account;
·
disclose, restrict, or access
information that you have provided or that is made available to you when using
your account.
We do not sell your Personal Information or content and will not share or disclose any of your Personal Information or content with third parties.
‘The Laws of Motion’, ‘LOM’ and all logos related to the Laws of Motion services are either trademarks or registered trademarks of CR Squared People Catalysts or those of the Training Provider. You may not copy, imitate, modify or use content, graphics or pictures of LOM’s logo or pictures, content or scripts. All rights, title and interest in the LOM content and services is the exclusive property of CR Squared People Catalysts Pty Ltd.
Users of the system may wish to include material that they have acquired over time which was created by organisations or individuals who are not part of their school.
It is the responsibility of the course owner, and the
school to which they belong, to ensure that the school has permission to use
such material as content in their course.
Should LOM receive requests to remove such material we inform the school under
the ‘takedown requests’ provisions below.
Users and Training Providers indemnify and hold
harmless CR Squared People Catalysts Pty. Ltd., our affiliates, directors and service
providers from and against any and all claims, costs, damages, losses,
liabilities and expenses (including reasonable attorneys’ fees and costs)
resulting from any claim arising from or related to:
· a breach of this User Agreement and Terms of Service or any claims or disputes brought by users arising out of their use of LOM Products
·
training school or user material
and uploaded content
This indemnification obligation is subject to Users and or Training providers
receiving (a) prompt written notice of such claim (but in any event notice in
sufficient time to respond without prejudice); (b) the exclusive right to
control and direct the investigation, defense or settlement of such claim and
(c) all reasonable necessary cooperation by us at the User and or Training
Providers expense.
· invoicing users, or student for fees
· creating users, including credentials and user roles, on the platform within the limits set for the school
· managing user access. Training schools retain the right to suspend access to a student for reasons on non-compliance with this agreement or non-payment of fees.
· assigning courses to students
· managing and setting up school specific courses, video conferences, discussion groups and instructor led training (ILT)
· communicating with students either individually or as participants in a course
· answering questions from students relating to the course content presented by the school
· direct their questions relating to the content of LOM courses or the functioning of the system to the school liaison manager
· paying the applicable fees that their Training Provider demands, which permit access and use of the ‘school’ and content made available for the ‘school’
· keeping user IDs and passwords for the ‘school’ strictly confidential and do not share such information with any unauthorized person. User IDs are granted to an individual or a named person and may not be shared,
· immediately notifying LOM of any unauthorized use of any user’s account and password by contacting support@thelawsofmotion.com
· maintaining personal account information, profile, password and email address.
· direct their questions relating to the content of the courses or the functioning of the system to the school administrator
· Set up and a Training provider’s ‘school’ unique web portal, with a unique web address (e.g. www.youruniqueschool-thelawsofmotion.talentlms.com to login and access online training and support material;
· Manage all queries relating to the availability of the training platform
· Maintaining ‘school’ information (i.e. school lists, users of ‘schools’, branches, etc.)
· Ensure LOM courses in use at the school are available and maintained
· Provide technical support on issues relating to the platform via email: support@thelawsofmotion.com) or through the in-platform messaging facility
· Suspend access to individual users, course content or schools should there be a breach of the user Agreement or Terms of Service.
· Suspend the activities of a school should the training facility subscription not be paid within the contracted time. Should this persist the school may be removed.
· Suspend access to LOM courses should the associated fees not be paid within the contracted time.
· Adjust the limit for number of users a school is contracted to have
· Manage all queries from ‘school’ staff (via support@thelawsofmotion.com)
· Provide training videos to familiarise school staff on the functions of the system
· Answer questions from school staff on the functioning of the system via the in-platform messaging facility
· Receive takedown requests of content.
CR Squared will use reasonable efforts to provide advance notice of removals
and suspensions when practicable, but if we determine that your actions
endanger the operation of the LOM ‘school’ or other users, we may suspend your
access or remove your data immediately without notice. We have no liability to
you for removing or deleting your data from or suspending your access to any CR
Squared service as described in this section.
CR Squared shall take all reasonable steps to protect the personal information of users. For the purpose of this clause, "personal information" shall be defined as detailed in the Protection of Personal Information Act 4 of 2013 of South Africa.
CR Squared People Catalysts (Pty) Ltd. is a private company based in South Africa trading as CR Squared with the registration number 2009/002725/07. The services provided are governed by the laws of South Africa.

Any new features that augment or enhance the current Service, including the release of new tools and resources, shall be subject to the Terms of Service. Continued use of the Service after any such changes shall constitute your consent to such changes.
